        These terms of use apply to all services provided to our subscribers and users in connection with our magazine “Numéro Switzerland” (hereinafter “Numéro Switzerland” and “Numèro Homme Switzerland”), our website numeromagazine.ch, and numerohomme.ch, and the newsletter of “Numéro Switzerland” (collectively “Offers”).

 

“Numéro Switzerland” is a product of the media type ROCHESTEIN GmbH, Paulistrasse 60, 8834 Schindellegi, Schwyz, Switzerland.

 

        By using the offers of “Numéro Switzerland,” you declare that you have read, understood, and accepted these terms of use. “Numéro Switzerland” reserves the right to change these terms of use at any time, to cancel a subscription at any time, or to refuse an extension of the subscription period, as well as to discontinue the newsletter.

        Change of the Terms of Use.

 

        “Numéro Switzerland” reserves the right to change these terms of use at any time. If the changes are material, they will be brought to the attention of subscribers and users by notification at a suitable place. The new version of the terms of use is valid from publication.

 

        Subsequent changes to the terms of use are deemed to be approved by the subscribers and users if they are not rejected in writing within 14 days of their acceptance. With the continued use of an offer, the respectively valid terms of use are considered accepted and accepted.

        Should individual provisions of these Terms of Use be invalid, invalid, or void, the other provisions shall remain unaffected.

 

Place of Jurisdiction and Applicable Law

        The place of jurisdiction is Schwyz (seat of Rochestein GmbH) or the Swiss residence of the customer. Swiss law applies exclusively to the express exclusion of any applicable rules of conflict of law.

  1. Special Terms of Use for the Individual Areas of “Numéro Switzerland”

1.1 Posts and Comments on Articles

        On numeromagazine.ch and numerohomme.ch, many articles are provided with a comment function. This is intended to serve the exchange of views.

 

        In principle, “Numéro Switzerland” is responsible for any publication on your Internet platform. This is also the case for those contributions that come from users. Therefore, deletions (in whole or in part) of comments are reserved at any time, even without prior notice. This applies in particular to contributions that are personality-injuring, offensive, discriminatory, or racist or that otherwise violate the law. Even if the comment function is misused to disseminate untrue statements or commercial intentions are behind the contributions, they will be deleted without request.

 

        Published content by users can be found on search engines; “Numéro Switzerland” does not influence the deletion of content in search engines.

 

        Users undertake not to violate Swiss law with their content and/or to violate the rights of third parties. In particular, users undertake not to write any immoral, personality, competition-infringing, or emanating, racist, violence-glorifying, threatening, pornographic, or obscene content and to protect the copyright, trademark, and other rights of third parties.

        Should third parties bring a lawsuit against “Numéro Switzerland” or its organs and employees in connection with the content or the behavior of the readers and/or assert claims for damages, the responsible users must indemnify and hold harmless “Numéro Switzerland” and/or its organs and are in particular obliged to assume all claims arising therefrom including the associated legal and court costs.

 

        1.2 Editorial Newsletter

        When registering for the “Numéro Switzerland” newsletter, you acknowledge and accept that the editorial staff of numeromagazine.ch and numerohomme.ch may send you editorial newsletters by email. You can unsubscribe from the “Numéro Switzerland” newsletter at any time by clicking on the unsubscribe link or by contacting our subscription service.

 

 

        Subscriptions

 

        2.1 Contract Conclusion, Renewal and Termination, Print Subscriptions, and Digital Subscriptions, Costs and Invoicing

 

        The contract between you as a subscriber and “Numéro Switzerland” is concluded after “Numéro Switzerland” has accepted your order using order confirmation. This order confirmation contains the essential contents of your order and will be sent to your specified email address.

        With your order, you accept our terms of delivery and payment.

 

        The subscriptions (print and digital) always have a certain duration, which can be found in the respective offer. Concerning the renewal, we distinguish between two cases of renewal of a print subscription or a digital subscription:

 

        If you pay for the subscription via payment slip, its term will not be automatically extended. You will receive an offer for subscription renewal before the subscription expires. If you pay the corresponding invoice, the contract will be extended for the same duration as the original subscription.

 

        If you pay for the subscription by credit card, the term of the subscription is automatically extended by the same, previous term. However, you will be informed in good time about the extension (approximately 7 days before the automatic renewal). Please inform our subscription service of any cancellations before the start of the new subscription period. After the start of the new subscription period, you can revoke the charge of the subscription price at your credit card company by its provisions (usually within 30 days of delivery of the credit card company’s statement), with which you will receive a corresponding refund, and the subscription is thus automatically canceled.

 

        In principle, completed print subscriptions and digital subscriptions cannot be properly canceled before the end of the fixed term. A refund of the subscription fees already paid is also not possible. We reserve the right to terminate for good cause. In this case, a pro-rata refund of the subscription fees already paid will be made.

 

        2.2 Payment Options

 

        You pay for print subscriptions against the invoice within 30 days. Digital subscriptions can also be paid for by credit card. Please use our payment slip when paying against the invoice. If you make your payment electronically, the VESR number of the payment slip must be indicated. If the invoice sent to you is incorrect, we will ask you to return the invoice, and we will check the error immediately and send you a new, correct invoice. The payment period is 30 days from the invoice date, without deduction of discount. The contract and invoice currency are the Swiss franc (CHF). Any billing is only permitted after consultation with the “Numéro Switzerland” subscription service.

 

       

 

2.3 Prices / VAT

        The prices quoted are inclusive of VAT (MWST) apply to direct sales to private individuals in Switzerland.
